*** Source: Early California Wills, California: California Society, D.A.R., 1952, 952 pgs. *** ---page 6-7--- 7 Will of Martha Williams continued Eighth: In case of the death of said daughter before her marriage or majority....my said Executors shall cause all property.....to be sold by them at public or private sale....after deduction of the expenses therefrom the proceeds shall be equally divided between my brothers and sisters who may be then living both the whole and half blood. Ninth: As the verbal contract made by me with Richard M. May is understood by my Executor Peter O. Miner, it is my desire the same be carried into effect as understood. Tenth: As I have understood that Olly Williams, father of my late husband of the County of St. Louis, State of Virginia, has a charge against my late husband for board and housekeeping. I desire my executors in payment thereof to send him by mail or otherwise a certain receipt of his amongst my papers, given to my late husband dated 28 March 1848 for the collection from A. Ellis of about $340.00 which he has collected from said Ellis.....and I desire that he nor any of my relations or connexions shall take any steps for the management of my said estate or guardianship of my said daughter. Eleventh: I desire that my executors shall not in any way dispose of the gold specimens I leave, but that they shall be kept and delivered to my said daughter at her marriage or majority. All other moneys... my executors.. may invest for the benefit of the estate...... Twelfth:......by this testament I hereby convey to my said Executors, Isaac Branham and Peter O. Miner, all my said property, both real and personal and mixed. In trust for the purposes and uses in this will recited..... And in the case of the death, resignation or removal from the state of either of my said Executors I do hereby rest full power and authority in the remaining Executor.
