(Will filed in records of County Clerk, San Jose, Santa Clara County, California) Dated: 4 Sept. 1851. Heir: Dr. J.L. Hornsby of Plaquemene, Louisiana. All real and personal property to be held in trust for his children, Joseph, Dashiel and Arabella Lewis Hornsby, in equal portions or if either should die before majority then for the sole use of the survivor......provided that the said Hornsby shall have full power to sell the said property or dispose of the same as he may deem proper and use the funds according to his discretion as he thinks may best accord with the interests of the said children, and the portion of the said D. Hornsby shall be given him deducting losses, expenses, etc. when he shall be twenty-one years of age and that of Arabella L. Hornsby, or what remains after said deductions, shall be given her at the age of eighteen years, or sooner, if she marry with the consent of her father or guardian....a deduction of ten per cent which the said Hornsby shall take from the cash value of my property to apply toward building atomb over the body of my mother...... . I appoint H.C. Melone or J.J. Kendrick, in the alternative, to take charge of and administer upon my estate until the same can be taken possession of by the said J.L. Hornsby....
