(Will filed in Will Book A, County Records, San Jose, California.) Dated: 20 May 1852. Filed: September 1, 1856. I, Andrew I. Yates, a resident of the City of San Jose, County of Santa Clara, State of California, being of sound and disposing mind and memory do hereby make, publish and declare this my last Will and Testament, revoking and cancelling all and any wills or codils of wills heretofore made by me. First: I do constitute my wife Matilda H. Yates as administrator of my estate and that she exercise all the powers and duties of such without bond or security to be given as her part--with full power to sell, convey lease, mortgage, transfer, or otherwise dispose of all or any of my estate, real or personal, at public or private sale in such manner....as she may deem expedient. Second: I do nominate and appoint my said wife, Matilda, the Guardian of my minor children without any bond or security until they shall respectively come of the age authorized by Law to choose for themselves. Third: I do devise and bequeath unto my said wife and children for and during her natural life all property and estate, real and personal of every nature and description, to be for her benefit and maintainance and the education of our children to wit: William, Augusta, Catherine, Clement, and Rudolph, and to be disposed of by her to them in equal proportions at her decease, or sooner, if she shall so determine.
